Terms of Service

These Terms of Service ("Terms") govern your use of the Arbito account (our shared sign-in) and Rufio Stats (a volleyball stat-tracking app), each provided by Arbito LLC ("Arbito," "we," "us"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the services.

Arbito LLC also publishes general Terms & Conditions covering the whole Arbito ecosystem. Those still apply to your Arbito account, but where they conflict with this document, this document controls for Rufio Stats.

1. Eligibility

You must be at least 13 years old to create an account, and you confirm that when you sign up. If you are 13 to 17 (or under the age of legal majority where you live), you may use the services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Rufio Stats is intended for adults who run and follow volleyball teams. Do not create an account for a child under 13.

2. Your account

An Arbito account is optional — Rufio Stats works on your device without one. If you create an account, you are responsible for the activity under it and for keeping your sign-in secure. One Arbito account is intended to work across Arbito LLC's apps; today the primary app is Rufio Stats.

3. Your content and responsibilities

You retain ownership of the team, roster, and game data you create. You grant us the limited rights needed to store, process, sync, and display that data to provide the service and the sharing features you enable.

Because rosters may include information about minors, you represent that you are authorized to enter and share the data you provide, and that you will use the app's visibility controls responsibly. You are responsible for the accuracy of what you enter and for respecting the privacy of the players and people you record.

5. Subscriptions & billing

Core tracking of one team or one player is free and stays free. Paid plans unlock tracking more teams and players, additional stat-entry seats, and formatted exports.

How you're billed. Paid subscriptions are sold by Arbito LLC and processed by Stripe, our payment processor, at the price shown on the checkout page when you subscribe. You choose a monthly or annual term. Subscriptions renew automatically for the same term at the then-current price until you cancel, charged to the payment method you gave Stripe. Applicable taxes may be added at checkout. Rufio Stats subscriptions are not sold as in-app purchases through the Apple App Store or Google Play.

The free trial. Each account can start one free trial, once. It runs 30 days, needs no payment method, and never converts to a paid plan on its own. When the 30 days are up the account simply returns to the Free plan and keeps everything the Free plan includes. If you want the paid features after that, you subscribe deliberately — we will not charge you because a trial ended.

Promotional periods. From time to time we may offer a promotional free period — for example, a "Founding Season" for accounts created before a stated date — under the terms stated for that specific offer. At the end of a promotional period, the account returns to the Free plan and keeps everything the Free plan includes, unless you start a paid subscription. Where a specific offer states promotional pricing for continuing as a paid subscriber afterward, that pricing is honored per the terms of that offer.

Extra seats. Stat-entry seats beyond the ones your plan includes are an add-on billed monthly, per seat, on the same subscription. Adding or removing seats changes what you owe from the next billing period; a mid-period change may be prorated.

Canceling. Cancel any time from Billing → Manage subscription in the app, which opens the Stripe billing portal — no phone call, no support ticket. Cancellation stops future charges and takes effect at the end of the billing period you've already paid for; your plan keeps working until then, and the account then returns to the Free plan.

Price and plan changes. Prices and plan contents may change. We will give you notice before a change affects a renewal, and you can cancel before it takes effect.

Refunds are covered by our Refund Policy.

6. License & app stores (EULA)

We grant you a personal, non-transferable, revocable license to use Rufio Stats. Where the app is distributed through the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies and, to the extent of any conflict about the licensed application, controls. We do not publish a separate custom EULA.

If you obtained the app through the Apple App Store, the following also apply:

Where the app is distributed through Google Play, these Terms are likewise between you and Arbito LLC only. Google has no obligation to provide maintenance, support, or warranty for the app and is not responsible for claims relating to it.

7. Service availability

We work to keep the service reliable but provide it "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Features may change, and offline data depends on your device.

8. Limitation of liability

To the fullest extent permitted by law, Arbito LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the services. Our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim, or USD $100 if you paid nothing.

9. Indemnification

You agree to indemnify, defend, and hold harmless Arbito LLC and its members, officers, employees, and agents from and against any third-party claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to: the data and content you enter, upload, or share through the services; your use or misuse of the services; your violation of these Terms; or your violation of someone else's rights, including privacy, publicity, and intellectual-property rights.

We will notify you promptly of any claim we want covered and will let you control its defense — provided you don't agree to any settlement that admits fault on our behalf, or that obligates us to do or pay anything, without our written consent. We may participate in the defense at our own expense.

10. Copyright & DMCA notices

We respect copyright and respond to valid notices under the Digital Millennium Copyright Act (17 U.S.C. §512). If you believe material stored or displayed by Rufio Stats infringes a copyright you own or represent, send a written notice to our designated agent:

Your notice must include: (1) a physical or electronic signature of the copyright owner or someone authorized to act on their behalf; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material you believe is infringing, with enough detail for us to locate it; (4) your address, telephone number, and email address; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.

If we remove something of yours, you may send a counter-notice including your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification, your name, address, and telephone number, your consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, the Eastern District of Kentucky), and your agreement to accept service from the person who sent the original notice. If the original complainant does not file a court action within 10 business days, we may restore the material. We terminate the accounts of repeat infringers.

11. Termination

You may stop using the services and delete your account at any time from within the app — either just your Rufio Stats data, or your whole Arbito account. We may suspend or terminate access for violations of these Terms or to comply with law. You can export your data before deleting your account. Deleting your account does not by itself refund a subscription; see the Refund Policy.

12. Dispute resolution & arbitration

Talk to us first. Before either of us starts a formal proceeding, the one with the complaint agrees to write to support@arbito.co describing the problem and what would resolve it, and to work at it informally for at least 30 days. Most things get fixed here.

Binding individual arbitration. If that doesn't resolve it, any dispute arising out of or relating to these Terms or the services will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Madison County, Kentucky, at another location we both agree on, or by phone or video where the AAA rules allow it. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction. This section is governed by the Federal Arbitration Act.

No class actions. ARBITRATION AND ANY OTHER PROCEEDING BETWEEN US WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS. YOU AND ARBITO LLC EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is held unenforceable as to a particular claim, that claim — and only that claim — proceeds in court instead of arbitration.

Small claims and injunctions. Either of us may bring an individual claim in small-claims court if it qualifies, instead of going to arbitration. Either of us may also ask a court for injunctive relief to stop infringement or misuse of intellectual property.

You can opt out. You may reject this arbitration section by emailing support@arbito.co with the subject line "Arbitration opt-out," including your name and the email address on your account, within 30 days of first accepting these Terms. Opting out costs nothing, changes nothing else in these Terms, and we will not treat you differently for it. If you opt out, disputes go to the courts described in Section 16.

Some places do not allow mandatory arbitration or class-action waivers. Where that's the case, this section applies only as far as the law permits, and nothing here limits rights you have under consumer-protection law that you cannot waive.

13. Changes to these Terms

We may update these Terms as the product and law evolve. We will update the date above and, for material changes, provide a more prominent notice. Continued use after changes means you accept them.

14. Severability & waiver

If any part of these Terms is held invalid, illegal, or unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in full force. If we don't enforce a provision right away, we haven't waived it. Provisions that by their nature should survive — including Sections 3 (your content), 8 (limitation of liability), 9 (indemnification), 12 (dispute resolution), and 16 (governing law) — survive termination of your account.

15. Entire agreement

These Terms, together with our Privacy Policy and Refund Policy, plus the Arbito platform Terms & Conditions and Arbito account privacy notice that govern the shared sign-in, are the entire agreement between you and Arbito LLC about Rufio Stats and replace any earlier understanding on the subject. Where these Terms conflict with the general Arbito platform Terms, these Terms control for Rufio Stats. You may not assign these Terms without our written consent; we may assign them, for example as part of a sale of the business.

16. Governing law & contact

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules, except where a mandatory consumer law of your residence applies. For anything not subject to arbitration under Section 12, you and Arbito LLC agree to the exclusive jurisdiction of the state and federal courts located in Madison County, Kentucky.
